1.1. iDealwine.com SA, a public limited company, whose headquarters is located at 190 Rue d'Estienne d'Orves - 92700 Colombes - FRANCE, has set up a referral programme in order to promote its services.
1.2. The referral programme aims at encouraging iDealwine.com members to become iDealwine.com sponsors, that is to say have their friends discover iDealwine in order to generate registration and participation in online wine sales.
1.3. The involvement in sponsoring implies the complete agreement of this set of rules in its entirety, as well as Internet deontology rules, laws, regulations and all legal texts applicable in France.
2.1. Full regulations can be seen on the website. Members (either sponsors or sponsored persons) can ask questions related to rules and sponsorship by sending an email to [email protected].
2.2. The rules apply to all members willing to benefit from advantages and obligations related to the referral programme.
2.3. iDealwine.com SA reserves the right to bring any changes to the rules or the website at any time during the sponsorship program without notice nor obligation to motivate its decision and without being liable for this. iDealwine.com SA reserves in particular the right to alter for any reason the validity date of the sponsorship.
2.4. Any change in regulation will be released online and will come into force from the date of its online release. All sponsors and sponsored members will be deemed to have accepted it from the coming into force of the modification. Any member refusing one or any of the changes that have occurred would quit the sponsorship program and stop benefitting from the advantages related to the sponsorship.
2.5. iDealwine.com SA reserves the ability to interrupt the sponsorship program at any time, without notice nor having to justify it. In this case, iDealwine.com SA cannot therefore be held liable in any manner. Sponsors and sponsored members will not be granted any compensation of any kind.
2.6. iDealwine.com SA reserves the right to control the exact information given by participants. Participants to this program (sponsors and sponsored members) should authorise any verification concerning the validity of their partnership. The validation can be refused if there remain contentious elements after verification. Any false declaration will automatically lead to removal of participation. iDealwine.com SA reserves the right to sue any person who engages in or tries to fraud. iDealwine.com SA would not be liable for anything vis a vis the sponsors or sponsored members for the possible fraud committed.
2.7. In case of a breach from a sponsor or a sponsored member, iDealwine.com SA reserves the right to set aside in its own right any participation from the latter, without him being able to claim anything, as it is expected to do with any member.
3.1. Anyphysical person of legal age, having a postal address in Europe or in Hong Kong and being a registered member on the website can participate in the sponsorship.
3.2. Participation in the sponsorship is carried out online with a registration form in your personal account.
This form only appears after the first order of the sponsor.
3.3.It is understood that a valid sponsorship relationship implies that the sponsored member should not be already registered on iDealwine.com. The program applies to one person per household (same name, same address). There can be only one sponsored member designated per household (same name, same address). The sponsored member should have a different billing and delivery address from his sponsor and from his other sponsored members. Only one order per sponsored member will be taken into account for the attribution of the sponsor's dotation. The sponsored member should use his own computer and means of payment. If the sponsored member uses the same credit card as his sponsor, the sponsorship will not be taken into account. Sponsorship is for personal use only. Sponsored members should be of acquaintances friends or relatives of their sponsor. It is prohibited to publish sponsor codes on the internet. It is also prohibited for the sponsor to sponsor himself by creating two seperate client accounts. Those who try and place delivery to a third party and create artificial orders aiming at increasing the number of sponsored members will be excluded.
4.1. The validation of a sponsorship is subject to a minimum first order of €150 from the sponsored member on the iDealwine.com website. When going through the order, the sponsored member should expressly refer to the reference of his (or her) sponsor in the provided field. If the indication is missing, the sponsor relationship will not be valid.
Each valid sponsor relationship gives right to:
- A €15 purchase voucher for the sponsor.
- A €15, for his first order of €150 minimum for the sposored member.
5.1. The participation to the sponsorship program implies to know and accept the characteristics and limits of the internet and specifically those related to technical performance; response time to consult, ask or transfer information, risks related to internet connection and transmission. Consequently, iDealwine.com cannot be held liable in any circumstance including but not limited to:
- the content of services seen on the website and any information or information/data displayed on the services featured on the website;
- the transmission and/or reception of any information/data on internet;
- any dysfunction of internet network avoiding the completion of the sponsorship;
- the breakdown of any reception device or any communication line;
- loss of any paper mail or email and more generally the loss of any data;
- delivery issue;
- dysfunction of any software;
- consequences of any virus, bug, incident, technical dysfunction;
- any damage caused to any internet user's computer;
- any technical, material or software failure of any nature, avoiding or limiting the possibility to take part in the sponsorship or having damaged any internet user's system.

5.2. It is stated that iDealwine.com cannot be held liable of any direct or indirect damage coming from an interruption, any dysfunction whatever it is, and for any reason, or any direct or indirect damage resulting from a connection to the website. Internet users should take all appropriate measures in order to protect their own data and / or software stored on their computer hardware against any threat. Users are responsible for their connection to the website and their participation to the sponsorship.
5.3. More generally, iDealwine.com is not responsible in case of force majeure or unforeseen circumstances case beyond its control.
6.1. It was agreed that, except in the event of an obvious mistake, iDelawine.com SA can rely, in particular for the purposes of proving any act, fact or omission, the programs, data, files, recordings, operations, and her elements such as (follow up reports or other) under electronic, digital format or device, directly or indirectly established, received or stored by iDealwine.com SA notably in its IT system.
6.2. Sponsors and sponsored members are committed not to contest the acceptability, validity or probative force of the IT and electronic information previously stated, under any legal basis specifying that some documents have to be written, signed by the parties to build a proof. Hence, these elements considered can build proofs and if they are produced as mean of proofs by iDealwine.com SA in any contentious procedure or of other kind, they will be acceptable, valid, enforceable against the parties, in the same manner and conditions and with the same probative force as any established, received or stored written document.
7.1.The details of all participants will be used in accordance with the 2016/679 European Parliament regulation on the protection of the individual with regard to the processing and circulation of personal data and repealing the 95/46/CE directive (general data protection regulation) from the 27th April 2016 or any other law that replaces it. Participants have the right to access, correct and remove information concerning them.
7.2.In this respect, participants can refer to the general conditions regulating the site iDealwine.com SA and in particular to the relative dispositions regarding the site's privacy policy. They can also access their personal information for the purposes of correcting or deleting them.
7.3.Participants are informed that, in accordance with the provisions of the 2016/679 regulation, any person they sponsor must agree to the handling and processing of their name, address and email address.
This regulation is ruled by French law. Any case of dispute or disagreement that may arise between them regarding the validity, interpretation or execution of the sponsorship program will be taken before the Commercial Court of Nanterre – France only.
